The definition
Homologous use means the HCT/P performs the same basic function or functions in the recipient as it did in the donor. It is one of the criteria a product must satisfy to be regulated under Section 361 rather than as a drug or biologic.
The test is about function, not about the material being similar in a loose sense.
Worked examples
Homologous. Wharton's jelly cushions and structurally supports the umbilical vessels in the donor. Used to provide cushioning and structural support for joints and soft tissue in a recipient, the basic function corresponds.
Not homologous. The same material promoted as treating a neurological condition, an autoimmune disease, or as regenerating cartilage. None of those is the tissue's basic donor function, and a product marketed that way is being offered for a non-homologous use.
Why it matters practically
A product used non-homologously does not qualify for Section 361 and is regulated as a drug or biologic — requiring FDA approval it does not have. This is not a technicality; it has been central to FDA enforcement in this space, including litigation.
For a prospective patient, the practical translation is simple. If a clinic describes a birth tissue product as treating a disease, regenerating cartilage, or addressing a systemic condition, that description exceeds homologous use. Whatever else is true, the regulatory framing being presented is not accurate.
